Since the publication of the 1964 Surgeon Generals report, which characterized cigarette smoking as a health hazard of sufficient importance in the United States to warrant appropriate remedial action, and other convincing scientific evidence, the industry had been under an ominous legal cloud, in that it was open to liability lawsuits brought by the estates of smokers who had died of lung cancer and whose survivors could attempt to prove to the satisfaction of juries that the deceased had originally been lured into habitually smoking a particular brand by such advertising claims as Not a Cough in a Carload.
